Terms of sale
These terms of sale govern every order placed on the putsch.org shop. Placing an order implies full acceptance of these terms.
Seller
NYWAL, a French société par actions simplifiée with a share capital of €100, registered with the Nanterre Trade and Companies Register under number 990 053 654, EU VAT FR22990053654, registered office at 6 square de l'Hippodrome, 92210 Saint-Cloud, France. Contact: [email protected].
Scope
These terms apply to the sale of the items (clothing and accessories) offered on putsch.org to consumer buyers. Event ticketing is operated by Shotgun under its own terms and falls outside these terms.
Products
The items offered are those shown on the site at the time of browsing, subject to available stock. Pieces are produced in short runs: a sold-out item is not necessarily restocked. Photographs and visuals are as faithful as possible but are not contractual; essential characteristics (fabric, weight, fit, care) are stated on each product page.
Prices
Prices are shown in euros, all taxes included, excluding delivery. Delivery costs depend on the destination and are displayed before final confirmation. NYWAL may change its prices at any time; items are invoiced at the price in force when the order is placed. For deliveries outside the European Union, any import duties and taxes are payable by the recipient.
Ordering
Orders are completed on a Shopify-hosted checkout: cart summary, contact and address details, delivery choice, review, payment. The sale is concluded upon payment confirmation, evidenced by a confirmation email detailing the order. NYWAL reserves the right to refuse or cancel an order in the event of a prior dispute, serious suspicion of fraud or an obvious pricing error; the customer is then informed and fully refunded.
Payment
Payment is due at the time of ordering, using the methods offered at checkout (payment cards and digital wallets, subject to availability), secured by Shopify Payments. NYWAL stores no banking data. Items remain the property of NYWAL until full payment of the price.
Delivery
Shipped from Paris; zones, times and details are set out in the shipping policy, which forms part of these terms. Where no time is stated, delivery takes place no later than thirty days after the order (art. L.216-1 of the French Consumer Code). If that deadline is missed, you may direct NYWAL to deliver within a reasonable additional period, then cancel the order if delivery has still not occurred. Risk passes upon physical handover of the parcel.
Right of withdrawal
Under articles L.221-18 et seq. of the French Consumer Code, you have fourteen days from receipt of the last item of your order to withdraw, without giving any reason.
To exercise it, send an unambiguous statement to [email protected] before the deadline (the form below may be used). You then have fourteen days to return the item. Return costs are borne by you (art. L.221-23). The refund is issued within fourteen days of the withdrawal, to the original payment method, and may be deferred until the item is recovered or proof of shipment is provided (art. L.221-24). It covers the price and the original delivery costs at the standard rate.
You are only liable for any diminished value resulting from handling beyond what is necessary to establish the nature and characteristics of the item: a garment may be tried on, not worn.
Exceptions (art. L.221-28): items made to your specifications or clearly personalised cannot be withdrawn from; where this applies, the product page states it before ordering.

Legal warranties
Independently of the right of withdrawal, you benefit from the following legal warranties; the notice below is required by article D.211-2 of the French Consumer Code:
The consumer has a period of two years from delivery of the goods to invoke the legal warranty of conformity where a lack of conformity appears. During this period, the consumer only needs to establish the existence of the lack of conformity, not its date of appearance.
The legal warranty of conformity entitles the consumer to repair or replacement of the goods within thirty days of the request, free of charge and without major inconvenience. If the goods are repaired under the legal warranty of conformity, the consumer benefits from a six-month extension of the initial warranty. If the consumer requests repair but the seller imposes replacement, the legal warranty of conformity is renewed for two years from the date of replacement.
The consumer may obtain a price reduction while keeping the goods, or terminate the contract with a full refund against return of the goods, if: the seller refuses to repair or replace the goods; repair or replacement takes place more than thirty days later; repair or replacement causes major inconvenience to the consumer; the lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity. The consumer is also entitled to a price reduction or termination where the lack of conformity is so serious as to justify an immediate remedy, without first requesting repair or replacement. The consumer is not entitled to termination where the lack of conformity is minor. Any period during which the goods are immobilised for repair or replacement suspends the remaining warranty until delivery of the restored goods.
These rights arise from articles L.217-1 to L.217-32 of the French Consumer Code. A seller who obstructs the legal warranty of conformity in bad faith incurs a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (art. L.241-5).
The consumer also benefits from the legal warranty against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. It entitles the consumer to a price reduction if the goods are kept, or a full refund against their return.

Consumer mediation
In the event of a complaint, write first to [email protected]: written complaints receive an answer. If the disagreement persists after that step, or if we have not answered within two months, you may refer the dispute free of charge to the consumer mediator NYWAL subscribes to (art. L.612-1 of the French Consumer Code):

The dispute may be filed online at cm2c.net or by post at the address above, within one year of your written complaint to us (art. L.612-2). Mediation is free for the consumer, apart from any representation or expert costs. You remain free to bring the matter before the competent courts at any time.
Language and governing law
These terms are governed by French law. The site is published in thirty-eight languages for information; in case of discrepancy, the French version of these terms prevails. Consumers benefit from the protective jurisdiction rules applicable to them.
